III. Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  • Review the notice promptly.

  • Remove or disable access to the allegedly infringing material, where appropriate.

  • Notify the user or party responsible for the content, when feasible.

  • Provide information about submitting a counter-notice, if applicable.

We aim to respond to properly submitted notices within 2–3 business days during our normal operating hours (Monday–Friday).

IV. Counter-Notice Procedure

If your content was removed or disabled due to a DMCA notice and you believe this was a mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Identification of the removed material: A description of the material that was removed or disabled and the location where it appeared before removal.

  2. Good-faith statement (under penalty of perjury): A statement that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.

  3. Your contact information: Full legal name, mailing address, telephone number, and email address.

  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the appropriate United States District Court (for the district in which your address is located, or if outside the U.S., for the judicial district of Pennsylvania) and agree to accept service of process from the person who submitted the original DMCA notice or their agent.

  5. Signature: A physical or electronic signature.

Unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the material within 10–14 business days after receiving a valid counter-notice.

V. Repeat Infringer Policy

In appropriate circumstances and at our discretion, Brycen Floral may suspend or terminate access to the Site or services for users who are determined to be repeat copyright infringers.

VI. Misrepresentations (17 U.S.C. §512(f))

Please be aware that any person who knowingly misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.

VII. How We Handle DMCA Records

  • We may forward a copy of a DMCA notice or counter-notice (including contact information) to the affected party for transparency and response purposes.

  • We may retain records of notices, counter-notices, and actions taken to comply with legal and auditing requirements.
